General Terms and Conditions (GTC)
Important note regarding the debt moratorium:
DeinDeal AG has been subject to a court-approved debt moratorium since 7 August 2026. Certain provisions of these GTC reflect the related legal and operational framework, deviate from the previously applicable terms and are exceptional in nature, in particular the exclusion of any warranty (to the extent permitted by law) and the exclusion of the right of withdrawal and of return.
1 Subject matter and scope
1.1 General provisions
1.1.1 On the websites operated by DeinDeal AG (hereinafter “DeinDeal”) www.deindeal.ch (hereinafter “DeinDeal.ch”) and www.my-store.ch (hereinafter “My-Store.ch”, “Mystore.ch” and “DeinDeal.ch” together hereinafter the “Websites”) or on the corresponding mobile applications, promotional offers (hereinafter “Deals”) are offered for sale to the customer (hereinafter the “Customer”) at discounted terms for a limited period, as part of sales campaigns:
● vouchers for obtaining services and goods from other companies (hereinafter “Vouchers”); and
● services or goods from other companies (hereinafter “Products”).
1.1.2 DeinDeal's services are limited to operating the Websites, publishing and promoting the Deals, technically processing the conclusion of the contract, sending the corresponding proof (Vouchers or order confirmations), shipping Products and collecting the corresponding purchase prices. With respect to the purchase of Vouchers, however, DeinDeal always acts solely as an intermediary for the companies offering the Vouchers via DeinDeal.ch and/or My-Store.ch (hereinafter the “Partners”). When Vouchers are purchased, a purchase contract is always concluded directly between the Customer and the Partner. DeinDeal is not the Customer's direct contractual partner in this respect.
1.1.3 The use of the Websites, of DeinDeal's services (as operator of these Websites) and of all related legal relationships is governed exclusively by these General Terms and Conditions (hereinafter the “GTC”).

1.1.5 The GTC are accepted either by ticking the corresponding box during the ordering process, or by the Customer using the Websites or other services of DeinDeal. The GTC can be accessed, printed or saved locally at any time on My-Store.ch and DeinDeal.ch under General Terms and Conditions.
1.1.6 The following provisions under Section 2 apply exclusively to the purchase of Vouchers (for the purchase of Products, see Section 3 below).
2 Provisions for the purchase of Vouchers
2.1 General
2.1.1 DeinDeal offers the Vouchers on behalf of the respective Partner, receives the Customers' payment and forwards it to the Partners. For all Vouchers, DeinDeal acts as an intermediary (third party) between the Customer and the seller.
2.1.2 The Voucher entitles the Customer to obtain a product from the DeinDeal Partner. This applies only for a specific period of time and at discounted terms as set out in the detailed description of the Deal. If a validity period is stated on the Voucher, the Voucher may only be redeemed with the Partner within that validity period. If the Customer does not redeem the Voucher within the validity period, the Customer forfeits the right to obtain the corresponding product and the Voucher lapses without compensation, unless special conditions deviating from this rule are expressly stated in the Deal.
2.1.3 The sale of the Voucher is only concluded once DeinDeal has successfully processed the Customer's payment. If the payment is unsuccessful (e.g. because the credit card number is incorrect or the credit card limit has been exceeded), the sale of the Voucher does not take place.
2.1.4 After a successful purchase, the Voucher is stored in the Customer's My-Store.ch/DeinDeal.ch account and is available as a PDF for download and printing. It contains all the relevant data required for redemption.
2.1.5 All Vouchers bear a code number, which the Partner checks against a list available to it upon redemption. Vouchers are transferable unless otherwise stated on the Voucher. Reproducing, editing or tampering with Vouchers is not permitted. DeinDeal reserves the right to take legal action in the event of misuse.
2.1.6 Unless otherwise stated in the description of the Deal, a Voucher may only be redeemed once.
2.1.7 The duration of the sales campaigns is limited and is set individually by DeinDeal for each Deal. No further purchase of Vouchers is possible once the time has expired. Should a Deal be incorrectly displayed as still available after its expiry due to a technical error, DeinDeal is entitled to declare a contract for the purchase of Vouchers or Products non-binding. Any payments already made will be refunded to the Customer without delay.
2.1.8 The relevant Partners are solely responsible for the proper and defect-free performance of the Products to be obtained by means of the Vouchers, and DeinDeal provides no warranty in this regard. Nor is DeinDeal liable in the event that the Partner is no longer able to provide the service embodied in the Voucher. This applies in particular to cases of cessation of business, subjective or objective impossibility of performance (whether at fault or not), including any bankruptcy, liquidation or similar proceedings affecting the Partner. Should technical or logistical problems arise when redeeming the Voucher or delivering the Products, DeinDeal will attempt to find a solution. In such a case, the Customer must contact DeinDeal during the validity period of the Voucher via the contact form or by telephone. Under no circumstances is DeinDeal liable for the service to be redeemed with the Partner using the Vouchers or for Products to be obtained from the Partner, nor for any resulting damages or consequential damages arising from defects. Liability for such claims rests exclusively with the Partner in accordance with the contracts concluded between the Partner and the Customer, to the extent that liability arises therefrom.
2.2 Right of withdrawal in general
2.2.1 Withdrawal is excluded.
2.3 Special conditions for “Travel” Deals
2.3.1 The purchase of a travel service offered by a Partner of the “travel provider” type on My-Store.ch and/or DeinDeal.ch requires acceptance of that Partner's terms and conditions.
Booking, payment of the balance, order confirmation and contact with customer service take place exclusively through the third-party partner and in accordance with the terms expressly stated in the purchased Voucher and in the Partner's terms and conditions. Any cancellation or amendment costs are borne by the Customer.
3 Provisions for the purchase of Products
The following provisions under Section 3 apply exclusively to the purchase of Products (for the purchase of Vouchers, see Section 2 above).
3.1 General
The Customer acknowledges that the Products can only be offered on the Websites at discounted terms because, as part of a sales campaign, several Customers purchase the relevant Products simultaneously and on the same non-negotiable terms, allowing DeinDeal to obtain and/or have these Products delivered from a product supplier at correspondingly discounted terms.
3.2 Alcoholic beverages, tobacco products and nicotine products
Alcoholic beverages, tobacco products and nicotine products are not sold to persons under the age of 18. During the ordering process, the Customer must confirm that he or she is 18 years of age or older. If this minimum age has not been reached, the Customer cannot accept the offer and no contract can be concluded. The Customer is obliged to provide truthful information about himself or herself. DeinDeal reserves the right to request a copy of an ID card or similar proof of age without giving reasons.
3.3 Delivery terms
3.3.1 Deliveries are made only within Switzerland, to the address provided during registration or ordering (hereinafter the “Address”).
3.3.2 DeinDeal has been subject to a court-approved debt moratorium since 7 August 2026 and must therefore reserve the right to withdraw from the contract at any time prior to delivery of the purchased goods, without giving reasons, and to refund the purchase price paid instead of delivering the purchased Product.
3.3.3 In the event of an incorrect or incomplete address, or if delivery is not possible during normal business hours, DeinDeal provides no guarantee of delivery of the Product. DeinDeal reserves the right to withdraw from the contract should delivery fail twice. In such a case, payments already made by the Customer will be refunded, less the shipping costs incurred.
3.3.4 Delivery costs are borne by the Customer. The amount of the delivery costs, including VAT, is shown during the ordering process on DeinDeal.ch or My-Store.ch and may vary depending on the offer or Product.
3.3.5 Information on availability and delivery times is provided during the purchase process. Due to an IT infrastructure error, Products may unexpectedly be unavailable. In such a case, the rule set out in Section 3.3.2 applies.
3.3.6 Following proper dispatch, DeinDeal assumes no liability in the event of theft, loss or any damage to a parcel. The risks associated with shipping pass to the Customer as soon as the parcel is handed over to the carrier.
3.3.7 Deliveries of individual items are made to the kerbside. Depending on the supplier, delivery to a specific floor and assembly may be requested for an additional charge, but are not included in the purchase price unless expressly stated.
3.3.8 In cases of force majeure, the delivery time may be extended or delivery may become entirely impossible. Force majeure includes, in particular, strikes, lockouts, official interventions, energy and raw material shortages, transport bottlenecks, operational disruptions caused, for example, by fire, water or machine damage and lightning strikes, failure of the IT infrastructure, and any other impediments, such as delayed delivery by product suppliers, that DeinDeal could not foresee and for which it is not responsible.
3.3.9 DeinDeal will inform the Customer by e-mail in the event of a delay. However, this does not in any case give rise to a right to cost reimbursement or compensation. Should a Product not be deliverable, DeinDeal will also inform the Customer by e-mail and refund the purchase price. Any further claims (e.g. for expenses or damages) against DeinDeal are excluded. In particular, the Customer has no right to delivery of the Product (no right to specific performance).
3.4 Retention of title
Title to the Products only passes to the Customer upon full payment of the purchase price. DeinDeal is entitled to have a corresponding reservation entered in the competent register of retention of title agreements. By confirming these GTC, the Customer consents to all essential points regarding the entry of such a retention of title. In addition, the Customer is obliged, upon DeinDeal's first request, to confirm again in writing his or her consent to all essential points regarding the entry of the retention of title (Art. 4 para. 4 of the Federal Supreme Court's Ordinance on the Registration of Retention of Title Agreements). The Customer is not entitled to resell a Product until the relevant purchase price has been paid in full. DeinDeal is entitled to invoice the Customer for verified costs and expenses incurred in registering the retention of title.
3.5 Right of withdrawal
The Customer has no right of withdrawal, and the return of delivered goods purchased as part of the sale conducted during the debt moratorium, i.e. from 7 August 2026 onwards, is excluded.
3.6 Default
If delivery does not take place within 30 (thirty) days after expiry of the delivery period stated in the detailed description, the Customer has the right to withdraw from the contract. In this case, payments already made will be refunded to the Customer. Any further obligation to pay damages and any other claims against DeinDeal are excluded.
3.7 Incorrect and defective goods
3.7.1 To the extent permitted by law, DeinDeal excludes all statutory warranty claims for material or legal defects in the delivered Products. In particular, there is no entitlement to rescission, price reduction, repair or replacement delivery. Claims that cannot be excluded under mandatory law, in particular in the case of defects fraudulently concealed, remain reserved.
3.7.2 The Customer must check the delivery as soon as possible after receipt. If a Product other than the one ordered has been delivered, or if the delivery is incomplete or obviously damaged, the Customer must notify DeinDeal within 2 (two) working days of the delivery date, via the contact form or by telephone.
3.7.3 Notwithstanding the exclusion of warranty under Section 3.9.1, DeinDeal may, at its own discretion, provide a replacement delivery or refund the purchase price paid for the relevant Product in the event of an incorrect or incomplete delivery or a defective Product. To the extent permitted by law, the Customer has no entitlement to this.
3.7.4 If DeinDeal requests the return of the Product, the Customer must return it in accordance with the instructions of customer service. DeinDeal may make the refund or replacement delivery conditional on the prior return of the Product.
3.7.5 DeinDeal assumes no procurement risk. In particular, DeinDeal is not obliged to procure, repair or have repaired Products beyond the available stock or the quantities available from its suppliers.
3.7.6 Any manufacturer's warranties or supplier warranties remain unaffected by this exclusion of warranty. Where possible, DeinDeal will assist the Customer in asserting such warranties, or will assign the corresponding warranty claims to the Customer.
3.8 Manufacturer's warranty
3.8.1 All product-specific information is based on information provided by DeinDeal's product suppliers. DeinDeal uses this information for purely informational purposes and can therefore not be held responsible for its content. The same applies to photographs of items, which are published with the consent of DeinDeal's Partners.
3.8.2 The Customer acknowledges that DeinDeal does not manufacture the Products itself and does not provide any manufacturer's warranty. Such manufacturer's warranties exist, if at all, only to the extent set out in the detailed description of the relevant Product or, where applicable, on packaging inserts or warranty certificates supplied with the Product. Claims arising from such manufacturer's warranties exist solely against the respective product suppliers or guarantors (and not against DeinDeal). DeinDeal hereby assigns to the Customer, with effect upon the Customer's purchase of the relevant Product, any claims the Customer may have arising from such manufacturer's warranties in respect of the relevant Product and, to the extent such assignment is not possible, grants the Customer a corresponding authorisation to exercise such claims.
3.9 Prices
All sale prices are stated in Swiss francs and already include any applicable VAT. Shipping costs and, where applicable, fees arising in connection with the payment process are charged separately and are stated precisely in the order summary. The total cost of the order depends on the shipping method and, where applicable, the method of payment. DeinDeal reserves the right to change the prices of the Products and services offered at any time. The price shown on DeinDeal.ch or My-Store.ch at the time of the order is decisive for the conclusion of the purchase contract. If a discount is indicated for a particular Product or service, it is calculated on the basis of the difference between the sale price shown on DeinDeal.ch or My-Store.ch and the usual market price or another permissible reference in accordance with the Price Indication Ordinance. When calculating prices, DeinDeal is guided by the active Swiss market, with the exception of special offers. Comparative prices are for information purposes only and are not contractually binding.
3.10 Payment terms
Before completing the ordering process, the Customer has the option of choosing the method of payment. The following options are available:
● Payment by credit card, PostFinance Card or PostFinance e-finance: when paying for the order, the purchase price becomes due immediately and the account is debited upon completion of the order.
● Payment via the PayPal payment service: PayPal's General Terms and Conditions apply: http://www.paypal.ch. By confirming an order, the Customer expressly agrees to PayPal's terms and conditions.
4 Credit balances
Any credit balances credited to the Customer in the form of vouchers or credit notes on his or her DeinDeal.ch or My-Store.ch account prior to 7 August 2026 (the date the debt moratorium was granted) are, for legal reasons, suspended and cannot be redeemed for the duration of the debt moratorium.
5 Limitation of liability
5.1 To the extent permitted by law, all claims by the Customer arising from non-performance or defective performance are limited to the rights expressly provided for in these GTC, in particular under Section 3. Any further liability or obligation to pay damages on the part of DeinDeal is excluded.
5.2 DeinDeal is liable only for damages caused intentionally or through gross negligence by DeinDeal. Liability for slight negligence as well as for indirect and consequential damages, in particular loss of profit, loss of data, business interruption or other indirect financial losses, is excluded to the extent permitted by law.
5.3 To the extent permitted by law, DeinDeal's liability is excluded for damages resulting from acts or omissions of auxiliary persons, suppliers, manufacturers, logistics providers or other third parties.
5.4 In particular, DeinDeal is not liable for damages resulting from technical faults, cyber incidents, maintenance work, interruptions or restrictions in the availability of the platform, or events of force majeure, provided DeinDeal has not caused these intentionally or through gross negligence.
5.5 To the extent permitted by law, DeinDeal's liability, irrespective of the legal basis, is limited to the purchase price paid by the Customer for the relevant Product.
5.6 Claims whose exclusion or limitation is not permissible under mandatory law remain reserved.
6 Changes to services and technical errors
6.1 DeinDeal reserves the right to change, restrict or discontinue the scope and functionality of the Websites at any time.
6.2 Although DeinDeal strives for maximum availability, it cannot be ruled out that the DeinDeal.ch or My-Store.ch websites may be temporarily unavailable due to maintenance work. In isolated cases, this may also result in data loss. DeinDeal is not liable for any interruptions in the availability of DeinDeal.ch or My-Store.ch or for any data loss.
6.3 Where prices are incorrectly displayed on DeinDeal.ch or My-Store.ch due to a technical error, DeinDeal is entitled to declare a contract for the purchase of Vouchers or Products non-binding. Payments already made for purchases after 7 August 2026 will be refunded to the Customer.
6.4 The relevant Partners and product suppliers are solely responsible for the proper and defect-free performance of the Products to be obtained by means of the Vouchers, and DeinDeal assumes no liability or responsibility whatsoever in this regard. The Customer acknowledges that DeinDeal does not itself vet the Partners and assumes no responsibility if the products or services of third parties do not meet the Customer's expectations.
7 Intellectual property
DeinDeal and its Partners and product suppliers own all copyrights and other rights in DeinDeal.ch, My-Store.ch and in the content, information, images, videos and databases published via these Websites (“Protected Property”), or hold the consent or licences required for their use to the extent this Protected Property belongs to third parties. Any alteration, reproduction, publication, transmission to third parties and/or other exploitation of the Protected Property without the prior written consent of DeinDeal is expressly prohibited.
8 Data protection
The Customer is informed in detail in the privacy policy about the nature, scope and purpose of the collection, processing and use by DeinDeal of the personal data required to process orders. The privacy policy can be accessed on DeinDeal.ch. By accepting these GTC, the Customer also acknowledges the privacy policy.
9 Amendments to these GTC
DeinDeal may amend these GTC at any time at its own discretion. The Customer can find the currently applicable provisions on DeinDeal.ch. Should the Customer not agree with the amended GTC, he or she may no longer use DeinDeal's services.
10 Miscellaneous
10.1 Severability clause: Should any provision of these GTC be or become invalid or void, the validity of the remaining provisions shall not be affected. In the event a provision is invalid or void, it shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
10.2 Applicable law: Swiss law applies exclusively, to the exclusion of the provisions of private international law and the UN Convention on Contracts for the International Sale of Goods (CISG).
10.3 Place of jurisdiction: The courts of 8048 Zurich shall have exclusive jurisdiction over all disputes arising from or in connection with these GTC, the legal relationships falling under them and the contracts concluded via DeinDeal.ch with a Partner or Customer. However, DeinDeal and its Partners, with whom the Customer concludes a contract, are entitled to assert their rights at the Customer's domicile or before any other competent authority.
